A US citizen is capable of sponsoring an adoption green card for an child adopted from a foreign land if they are under 18 years of age. The adoption of an international child who is not a US citizen has several requirements. Any eligible family or single person who is a US citizen that is recognized and verified to perform the rightful duties of parenting can sponsor an adoption green card for a foreign child, but the process of getting a green card through adoption is pretty difficult. Genuine adoptions, however, are approved in most cases.
Eligibility requirements for a US Citizen to adopt a foreign child:
Adoption green card can be obtained to adopt non-immigrant foreign born children or orphans who currently reside in the US. AOS for an adoption green card can be sponsored by eligible parents who did adopt the child before 16 years of age and with whom the child had been continuing to live comfortably for a period of 2 years.
Adoption green cards can also be obtained to adopt foreign born children or orphans who reside in foreign countries.
At least one of the adopting parents should be a US citizen.
The applicant parent should have been be married or should produce proof of a legal divorce.
The applicant should prove the following before applying for the adoption green card:
Proof of financial stability to sponsor the foreign child for adoption.
Genuine moral motives are an important aspect that will be required for any applicant wanting to adopt.
The applicant should be able to provide proof of the child’s birth certificate or related evidence to confirm the age and original citizenship of the child.
The applicant should provide legal proof of the child being an orphan or a legal authorization for the adoption from the child’s parents as required by the INA
The applicant should file form I-600 to register the child as a legal immediate adopted relative when the above qualifications are duly met.
There are several reasons for why an adoption green card could be denied:
The child for adoption has communicable diseases or mental disorders.
The child has been involved in criminal activities.
USCIS suspects immoral motives of the person petitioning to adopt.
The proceedings and paperwork for adopting an orphan child is different from the proceedings to adopt a non-orphan with living parents. However, the sanctioning of both kinds of adoption green card is subject to close scrutiny of the USCIS.
