Green Card Rules

Green card rules are frames abiding by the immigration laws that dictate the duties of the USCIS and Department of Homeland Security. Green card rules are strictly adhered to before issuing the card to the applicant or the prospective nonimmigrant seeking Adjustment of Status or consular processing.

The primary requisite of any green card applicant should be that one should be the citizen of an eligible nation as proposed by the USCIS. There are separate rules applicable both for the sponsor who files the call petition and also the recipient applicant who receives the benefit.

As in cases of citizens filing the green card call petition the prospective US citizen or green card holder should submit an Affidavit of Support assuring the capacity to sponsor the relative or employee or spouse.

Green card rules applicable for employers include the filing for labor certification. The prospective US employer should file for a labor certification with the Department of Homeland Security stating that there are no qualifying US citizens or existing green card holder willing to work under this position:-
Green card rules also stress that the wage proposed for the applicant should comply with the US Department or Labor standards and prevailing wage laws.
The jobs should be a job that is full-time and bonafide, above all a legal one.
The employer should also show that the company is sound financially to hire a person in a well-paid position.
Labor certification is just a green flag to proceed further and not a proof of grant of immigrant status there are still miles of forms to be processed after this too.

Green card rules applicable for relatives and spouse include valid marriage proof and motives to be together. The applicant should show reliability and capacity to sponsor the foreign spouse.
If the spouse is divorced or widowed adequate proof of divorce or death certification of ex-spouse should be produced.

Similarly there are several related proceedings related to the age of the applicant, previous convictions for existing non-immigrants, disqualification from getting a green card, barring entrance for non-renewal and many, many, unlisted here.

Every aspect of immigration is governed by green card laws that vary for each group and each category and each nationality. Some nations are limited by the priority date and the number of entrants per year by immigration number quota, but still there are many member nations who are free to enter the US despite and against the quota rules. Above all green card rules works towards assigning the right people to live long in the United States.
