K1 Fiancee/Fiance Visa

K1 Fiancee/Fiance Visa is the official document issued to a non-US citizen or alien who is being married. K1 Fiancee/Fiance Visa is only for those people who plan their marriage within the US. Though it would take time for you to get a green card, yet you get your K1 Fiancee/Fiance Visa in a very short duration and can enter the US 90 days before the marriage which would give you a chance to understand your fiancée or fiancé better.

K1 Fiancee/Fiance Visa can also be got by AOS if the applicant is already a nonimmigrant visa holder.

The application process for K1 Fiancee/Fiance Visa starts with the filing of the Fiancé visa petition, form I-129F with the USCIS. It has an application fee that has to be sent along with it but no biometric fees. If your fiancée has minor or unmarried children (below 21 years of age) can accompany your fiancée. You must also submit the proof of your US citizenship.

K1 Fiancee/Fiance Visa application requires two completed and signed form G-325A, biographic information, one for your fiancée and one for you. You also have to submit two separate passport size photographs of your fiancée and yours.

If you are already married, then you have to show the proof of legalized termination of earlier marriages. This is followed by copy certification, form FC-029. Along with these, you also have to show the proof that you can legally marry, proof that you have met your fiancée within the past two years (how you met, dated photographs, engagement ring receipts, credit card receipts of both, etc). You would also have to submit copies of wedding announcements, evidence of wedding arrangements, letter from the person who will conduct your marriage ceremony, copies of cards or letters discussing your marriage plans, etc.

Once your application reaches USCIS and the processing begins, they will send you I-797C, Notice of Action. After the approval the process is transferred to NVC or National visa Center which is further handed over to the consulate of your fiancée’ home country. Finally your fiancée and her children below 21 years of age have to go through consulate interview process.

Your fiancée can work in the US after getting Social Security Card and EAD. If you have a pending green card then you have to get an advance parole when travelling outside US. If there is a relationship failure before getting a green card, then your fiancée must leave the US.
